Clear limits before
anyone pays.

These Terms explain the rules for organizers, contributors, recipients, and visitors using Kinvoria.

1. Agreement and operator

These Terms govern your use of the Kinvoria service. Questions, notices, and complaints may be sent to the contact published below. By creating an account or project, submitting a recording, or using a private page, you agree to the parts that apply to your role. If you do not agree, do not use the service.

2. The service

Organizers use Google sign-in. An organizer can create a private occasion project, invite up to 20 contributors, collect recordings of no more than 90 seconds each, pay once to generate a chaptered radio, and receive a private listening page for 90 days plus an MP3 download. Contributors join through a private link and may continue as a guest or optionally use Google sign-in. The same Google account may have only one active contribution in a project. When an invitation is opened while signed out, a first-party random browser token checks guest duplicate status and is used if the contributor continues as a guest. The server stores only a project-scoped SHA-256 digest derived from that token and the project ID; if the contributor signs in, the token is ignored for that signed-in submission. It is not a MAC address, hardware identifier, or fingerprint. Clearing site data, private browsing, or changing browsers or devices may reset this safeguard, so it does not prove that two submissions came from the same or different person. Kinvoria is not permanent hosting, an emergency delivery service, a social network, or a full audio editor.

3. Eligibility and authority

People of any age may be organizers, contributors, recipients, project subjects, or intended listeners. A person who can validly agree under the law that applies to them may use the service on their own. If a person is below the applicable age of consent or otherwise cannot provide valid authorization, a parent or legal guardian must actively assist them and provide the permission or other lawful authorization required for their participation and information. Provider account rules and applicable law continue to apply.

The organizer must have each project subject's authority or another lawful basis to provide project information. When a child or another person who cannot authorize the processing themselves is involved, the organizer must obtain the required authorization from their parent or legal guardian and involve the guardian in the submission. Before creating the project, the organizer must provide the project subject, or their parent or legal guardian where appropriate, with the Recipient and project-subject privacy notice. We do not ask for or store a project subject's full date of birth. A birthday display age must be a whole number from 1 to 150. Entering an age does not replace the permission and notice steps above.

You may use the service only for personal, non-commercial gifts unless we agree otherwise in writing. Private contribution and listening pages may require a time-limited privacy and policy confirmation before private details are returned.

4. Your content and permissions

You keep ownership of content you submit. You grant us a limited, worldwide, non-exclusive license to receive, validate, transcode, normalize, assemble, host, play, download, rebuild, and delete that content only as needed to provide, secure, and support the service. The license ends when the content is deleted, subject to limited backups and legal retention described in the Privacy Notice.

You must have permission to submit each person's name, voice, story, photo, or other item. When the person cannot provide valid authorization themselves, that permission must come from their parent or legal guardian. Do not include unlicensed music, covert recordings, another person's private recording, or unnecessary sensitive information. The organizer is responsible for choosing contributors and sharing private links carefully.

Subject to those permissions and third-party rights, the organizer and intended recipient may permanently download, keep, play, and privately share the completed MP3 for personal, non-commercial use. This does not permit public or commercial distribution, sale, sublicensing, or use of anyone's contribution outside the intended private gift without any further permission that use requires.

5. Acceptable use

You may not use the service for harassment, threats, impersonation, surveillance, exploitation, fraud, spam, malware, unlawful discrimination, exploitation or endangerment of a child, infringement of intellectual-property or privacy rights, evasion of security controls, or any illegal purpose. You may not probe, scrape, reverse engineer, or overload the service except where applicable law expressly permits it. You may not deliberately reset or manipulate the guest duplicate-prevention token to submit more than one active contribution to the same project.

You may not submit or use audio that clones or imitates a real person's voice, falsely attributes words to a real person, or presents synthetic speech as that person's authentic recording.

Report suspected copyright, trademark, privacy, publicity, or other rights violations through the Contact page. Identify the project or material and explain your authority and the right affected, but do not email audio, passwords, or a full private link. We may restrict access while reviewing a report, request supporting information, preserve records required for the review, and remove or disable material when appropriate.

6. Price, payment, and taxes

The listed price is $9.99 USD once for one Kinvoria voice gift with up to 20 voices. Creating the page and collecting voices is free; payment occurs only after the organizer closes collection and requests the final build. There is no subscription. The total price and applicable taxes are shown before payment.

Paddle is the authorized reseller and merchant of record for the transaction: Paddle collects payment, handles tax and receipts, and applies its Buyer Terms. These Terms continue to govern the Kinvoria service and your content.

7. Delivery, review, and rebuilds

The event date and collection deadline are planning tools, not a guaranteed delivery time. Delivery depends on at least one valid included recording, completed payment, successful processing, network and provider availability, and the organizer's timely choices.

The organizer chooses inclusion and order before checkout. The purchase includes one organizer-requested rebuild to change order or exclude a voice while the required source recordings remain in their 30-day retention window. Technical retries and rebuilds needed to honor a valid deletion request do not consume that allowance.

8. Cancellation, withdrawal, and refunds

Before payment, an organizer can abandon or delete a project without charge. After payment, statutory withdrawal and refund rights vary by location and may be affected when digital delivery begins with your express agreement. Failed or materially defective delivery may qualify for a retry, replacement, or refund. The Refund Policy explains how to request help. Nothing in these Terms limits mandatory consumer rights.

9. Privacy, deletion, and expiry

The Privacy Notice explains collection, optional Google identity, guest duplicate prevention, sharing, international processing, retention, and privacy rights. Original uploads are queued for deletion 30 days after the first final render. The private player and processed audio are hosted for 90 days. A contributor can use a private removal link; organizers can delete projects, and deleting a signed-in account also removes voices that account contributed to other projects. Copies downloaded to another person's device cannot be remotely recalled.

10. Our service and intellectual property

We and our licensors own the service software, design, branding, and materials other than user content. We give you a limited, non-transferable right to use the service for its intended purpose while these Terms apply. That restriction does not prevent the organizer or intended recipient from using the completed MP3 as expressly allowed in section 4. Feedback may be used without restriction or payment, but we will not identify you publicly without permission.

11. Suspension and termination

We may restrict or suspend access when reasonably necessary to stop unlawful use, protect people or the service, investigate fraud or a security incident, comply with law, or address a material breach. Where appropriate and lawful, we will give notice and a chance to resolve the issue. You may stop using the service or delete your account at any time. If a payment confirmation is in progress, deletion may be delayed briefly so the transaction is not duplicated or misapplied; retry after payment settles. Provisions that by their nature should survive, including payment, ownership, legal-retention, and dispute provisions, remain in effect.

12. Availability and responsibility

We use reasonable care and skill to provide the service but do not promise uninterrupted availability, perfect audio quality, permanent storage, compatibility with every device, or a particular emotional outcome. Keep your own downloaded MP3 before hosted access expires.

Nothing excludes or limits liability that cannot lawfully be excluded, including liability for fraud or deliberate misconduct. Subject to that rule, each party is responsible for losses that are a reasonably foreseeable result of its breach. We are not responsible for loss caused by sharing a private link against our guidance, copies another person downloaded, unlawful submitted content, or events outside our reasonable control.

13. Changes to the service or these Terms

We may improve or change the service. If a change materially reduces a purchased feature before delivery, we will provide an appropriate remedy. We may update these Terms prospectively for legal, security, or product reasons. Material changes will be posted with a new effective date and communicated where appropriate. The version accepted at the time of purchase continues to govern that transaction unless law requires otherwise.

14. Governing law and disputes

These Terms do not make a separate contractual choice of governing law or exclusive dispute forum. Applicable law, including any mandatory consumer protections and available courts, continues to apply.

Any stated choice remains subject to mandatory protections and courts available to consumers under applicable law. Please contact us first so we can try to resolve a concern informally. You may also use any regulator, consumer authority, or dispute process available under applicable law.

15. General

If one provision is unenforceable, the rest remain in effect. A delay in enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, or sale if your rights are not reduced.
